Delays to family courts hearing cases continue during COVID Pandemic

Is alternative dispute resolution the way forward to deal with backlog of family court cases and increasing difficulty in accessing justice for families?

Due to Covid-19, family courts have experienced delays in processing applications and hearing cases. Cafcass states there is a “delay of up to 18 weeks in some family courts.” The delays and shortfall in accessing family justice are causing concern to many.

What should I do if I have not received any confirmation from your local family court about your application being processed?

We would advise to follow Cafcass guidelines, which suggest can contact your legal advisor directly or contact the court concerned directly to find out more.

As this thoughtful article dated 02/09/2020 published in The New York review of books highlights, the problem is not just confined to the UK.

Is there a solution? We hope that alternative forms of dispute resolution may be the way forward for some.
