Marginally higher number of family private law cases received by Cafcass

The number of private law cases received by Cafcass in August 2020 was marginally higher than the numbers received in the corresponding period of 2019.

Private law cases generally refer to applications made following a divorce or separation about the arrangements for children, such as where a child will live or with whom a child will spend time.

If you are going through a family law process of divorce or separation with children’s futures or child arrangements being discussed, you may well hear of or have contact with Cafcass. Cafcass, which stands for Children and Family Court Advisory and Support Service, become involved where parents or carers cannot agree on arrangements for their children.

Cafcass have a duty to safeguard and promote the welfare of children going through the family justice system. Cafcass has “Family Court Advisers” who may be asked by the family court to work with families. These specialists then advise the court on what they consider to be in the best interests of the children involved.
