Recent case highlights importance of pre-nuptial agreements
The Bertarelli case demonstrated how essential it can be to consider pre-nuptial agreements, prior to a marriage or civil partnership.
The Family Law Week reports the case this month awarding the wife a £400 million settlement, making her one of the ‘richest British born divorcees.’
However, there is speculation by lawyers that she could have been awarded a greater slice of the £9.2 billion fortune but for the existence of a prenuptial agreement between the couple.
Pre-nuptial agreements are now legally enforceable in the UK. Such agreements lays out how you and your partner would divide things fairly, in the event of a split. Such agreements need to be drawn up by an SRA accredited family solicitor and you and your partner both need to seek independent legal advice.
The latter will mean each partner having separate family solicitors. This is important as it means avoiding claims either was acting against their will, or involuntarily.
