Dispute resolution in England and Wales

The Ministry of Justice ‘call for evidence’ into dispute resolution services, including the family dispute resolution means and methods, is reaching its conclusion at the end of the month.

The call for evidence set out to look into how to change the dispute resolution service within and outside of the courts system to support the development of more effective dispute resolution mechanisms.

Mediation Information and Assessment Meetings (MIAMs) were introduced in family cases in 2014 as a form of alternative dispute resolution. However, the Ministry of Justice acknowledges that more still needs to be done to increase uptake of less adversarial options. The aim is for, wherever possible, alternative methods of dispute resolution to be the new main resource to support agreement.
