Recent case update - family law financial remedy litigation case deemed 'nihilistic' by Judge

A recent family law case looking at financial litigation has run to 34 court hearings, with total costs at about £2.3 million and a 6000 page court bundle.

In response the Judge called the proceedings ‘nihilistic,’ saying that parties and their lawyers ‘adopted a bitterly fought adversarial approach’ where each party thinks the other is ‘out to destroy’ them. He noted an almost ‘complete breakdown of constructive communication’ between the parties and their lawyers.

He highlighted the negative impact on the children involved. Naming the emotional pain of seeing their parents involved in ‘such bitter proceedings’ as well as the financial impact the costs would have, depriving them of future monies which could have benefitted them.
